The Agreement Between Us.

Effective 31 October 2026

Please read this page before you join. It contains an assumption of risk, a release of claims, and an agreement to resolve disputes by individual arbitration instead of in court or as part of a class action. By creating a profile you accept it.

1. Who We Are, and What This Covers

Baddie Be Well (“we”, “us”) runs an online community, a practice library, and live practice sessions. These terms apply to the website, the member portal, the tribes and forums, the job board and marketplace, and any class or session we host, whether free or paid. If you don’t accept them, don’t create a profile; if you already have one, stop using the service and ask us to delete it.

2. Eligibility: Eighteen and Over

You must be at least eighteen years old and legally able to enter this agreement. You confirm that when you create your profile, and we record that confirmation with a timestamp. Accounts that belong to minors will be removed. If you use the service on behalf of an organization, you confirm you may bind it.

3. Adult and Kink Spaces: Twenty-One and Over

Some parts of the community, including the Kinksters tribe, discuss adult subject matter such as kink, rope, impact play, and sexual health. Those spaces are limited to members who are at least twenty-one and who give an explicit acknowledgment before entering. When you check that box you confirm three things: that you are twenty-one or older; that you consent to being exposed to frank adult conversation; and that you will not share, request, or post sexual content involving minors, non-consensual acts, or anyone’s intimate images without their consent. We remove anything that crosses that line, remove the account, and report it where the law requires.

Adult conversation in these spaces is conversation. It is not instruction, it is not a substitute for consent negotiation with an actual partner, and nothing posted there is advice about safety, law, or health.

4. Your Account and the Community Rules

Keep your login to yourself, tell us if it is compromised, and use a name you have the right to use. Everyone must follow the code of conduct, which is part of these terms. You are responsible for what you post, including that it is accurate and that you have the right to share it.

5. Not Therapy, Not Medical Care, Not Legal Advice

Meditation, breathwork, yoga, and peer conversation are not psychotherapy, diagnosis, medical treatment, or legal advice. We do not screen members’ mental health, and no one here is your clinician. If you are in crisis, contact a crisis line or emergency services. Always check with a qualified professional before changing anything about your care.

6. Assumption of Risk

You understand that movement, breathwork, and meditation carry inherent risks, including physical strain, dizziness, emotional flooding, and the discovery of memories or feelings you were not expecting, and that reading other people’s accounts of trauma, kink, or mental health can be activating. You choose to participate, you decide what your body can do, and you stop whenever you need to.

You agree to consult a physician before physical practice if you have a condition that makes movement risky, to move at your own pace, and to treat anything you read from other members as one person’s experience rather than guidance for you.

7. Release of Claims

To the fullest extent the law allows, you release Baddie Be Well, its founder, stewards, teachers, and volunteers from claims for injury, loss, or damage arising out of your participation in the community, the practice library, or any session, including claims based on ordinary negligence.

This release does not cover gross negligence, recklessness, willful misconduct, or anything else that cannot lawfully be waived, and it does not limit rights you have under non-waivable consumer or employment law. You also release other members from claims arising from what they share here, except for their own intentional harm or defamation.

8. Agreement to Arbitrate, and the Class Action Waiver

You and Baddie Be Well agree that any dispute arising out of or relating to these terms or the service will be resolved by final, binding, individual arbitration, and not in court and not as part of a class, collective, or representative action. You and we each waive the right to a jury trial and to participate in a class action.

Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before one arbitrator, seated in Los Angeles County, California, and governed by the Federal Arbitration Act. It can be handled on the papers or by video wherever the rules allow, so you do not have to travel. We will pay the arbitration filing fees that the rules assign to us, and for a claim of $10,000 or less you may choose to have it decided on written submissions alone.

Three carve-outs, so you know exactly what this does not cover: either of us may bring an individual claim in small claims court where it qualifies; either of us may ask a court for an injunction to stop misuse of intellectual property or unauthorized access; and nothing here stops you from reporting something to a government agency or exercising a right that the law says you cannot waive.

You may opt out of arbitration and of the class action waiver by emailing hello@baddiebewell.com within thirty days of creating your account, with the subject “Arbitration opt-out” and the email address on your profile. Opting out changes nothing else about your membership. If this section is found unenforceable as to a particular claim, that claim goes to the state or federal courts located in Los Angeles County, California, and the rest of this section still applies.

9. Membership, Payments, and Cancellation

Free membership asks for newsletter consent and nothing else. Paid seats and verified subscriber access are described on the membership page; paid subscriptions are billed by Substack under its terms, and you cancel there. Verified subscriber access is complimentary and can be reviewed if a subscription lapses. We may change prices for future billing periods with notice, and we do not give retroactive refunds except where the law requires one.

10. Your Content, and Ours

You keep ownership of what you post and grant us a non-exclusive, worldwide, royalty-free license to host, display, and format it so the community works. You confirm you have the rights to grant that. Our name, marks, photographs, essays, and practice recordings are ours; don’t republish them without permission. We remove content that infringes copyright on notice to hello@baddiebewell.com, and we may remove anything that breaks these terms or the code of conduct.

11. Moderation and Termination

Stewards may remove a post, pause an account, or end a membership for harassment, defamation, or a breach of these terms, as described in the code of conduct. We try to be fair and to say why. You can leave at any time by deleting your profile; sections that by their nature survive (release, arbitration, content license for what others have already seen, and payment obligations) survive.

12. Disclaimers and Limits on Liability

The service is provided “as is”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we are not liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Where liability cannot be excluded, our total liability for a claim is limited to the greater of the amount you paid us in the twelve months before the claim or one hundred dollars. Nothing in these terms limits liability for fraud, willful injury, or anything else the law does not allow us to limit.

13. Governing Law, and the Rest

California law governs these terms, without regard to conflict-of-laws rules, and the Federal Arbitration Act governs section 8. If any part of these terms is unenforceable, the rest stays in force. Our not enforcing something once is not a waiver. These terms, the code of conduct, and the privacy policy are the whole agreement between us. We may update them, and material changes will be noted with a new effective date; continuing to use the service after that means the updated terms apply.
